In Redwood City School District (RCSD), we recognize and respect the community’s interest in seeking information and clarity about district educational programs, policies, and the well-being of our students. The district must also prioritize maintaining a delicate balance between transparency and confidentiality to uphold the trust and privacy of our students, families, and staff members. 

While we strive to provide as much transparency as possible within the bounds of the law, we are equally committed to protecting the privacy rights of individuals. Laws such as the Family Educational Rights and Privacy Act (FERPA) and California Education Code set clear boundaries on the disclosure of student records and personal information. These laws ensure that sensitive details about students, families, and staff are handled with utmost confidentiality, respecting their rights to privacy.

RCSD’s approach to communication strikes a careful balance, where we communicate openly about general policies and procedures while safeguarding confidential information. This balance ensures that our educational community can trust that their personal information is handled responsibly and with respect for legal and ethical standards.

Legal Framework

The District is subject to a number of state and federal laws intended to protect student and family privacy. These laws include:

1. Family Educational Rights and Privacy Act (FERPA):

FERPA is a federal law protecting the privacy of student education records. It grants parents rights regarding their children’s education records, including the right to inspect and review records and request corrections if necessary.

2. California Education Code:

  • Sections 49060-49078: These sections outline state laws regarding student records privacy, emphasizing confidentiality and the rights of parents and eligible students.
     
  • Section 51101: Requires local educational agencies to adopt policies on parental involvement, including transparent communication and parental access to information.

3. Board Policies

RCSD’s Board policies complement legal requirements to ensure clarity and consistency in our approach to communication and confidentiality:

  • Board Policy 5125: Student Records - Outlines procedures for the maintenance and access to student records in compliance with FERPA and state law.
     
  • Board Policy 6020: Parent Involvement - Emphasizes transparent communication between the district and parents, encouraging partnerships in education.
     
  • Board Policy 1100: Communication with the Public - Guides district staff in ensuring transparency in communication while respecting confidentiality. 
     
  • Board Policy 5020: Parent Rights and Responsibilities - Acknowledging that parents have certain rights and responsibilities related to the education of their children.
     
  • Board Policy 5022: Student and Family Privacy Rights - Respecting the rights of district students and their parents with regard to the privacy of their personal beliefs and the confidentiality of their personal information.
     
  • Board Policy 5125.1: Release of Directory Information - Setting forth the circumstances in which the District may release directory information about students.

Handling Inquiries About Student, Family, or Staff Details

1. Communication Protocols:

  • Individual Situations: RCSD does not communicate to the entire school community or the public at large when a situation involves specific details about a single student or staff member. Families and staff members can expect direct communication from the school if their child or they are directly impacted.
     
  • Privacy and Confidentiality: We uphold strict privacy and confidentiality standards, ensuring that sensitive information is not shared beyond those directly involved without authorization.
     
  • Whole School Impact: If a situation impacts the entire school community, RCSD will notify all families and staff members directly to provide necessary information and support.

2. Types of Information Shared:

  • General Information: RCSD shares general policy-related information without compromising confidentiality.
     
  • Legal Limitations: Specific details about personal information, academic records, or disciplinary matters are not disclosed without consent, unless legally permitted or required.

3. Communication Channels:

  • Direct Communication: Inquiries are addressed through direct channels with involved persons, such as meetings, phone calls, or written correspondence to uphold privacy.
     
  • Public Statements: When permissible and necessary, RCSD issues public statements that uphold confidentiality while providing relevant information.

4. Educational Outreach:

  • Community Education: RCSD educates the community about confidentiality laws and our commitment to protecting privacy rights.
     
  • Staff Training: Staff members receive training on confidentiality guidelines to ensure legal compliance and ethical practices.
